Discipline system for senior administrative posts

Abstract

It is known that the administrative system is influenced to a large extent by the personality of its administrator; therefore it is usually described, metaphorically, as being likechameleon which derives its color depending on its administrator. Consequently, the higher degree of the job in the administrative ladder, the greater the influence will be on choosing its employeesand their qualifications; where these jobs are considered from one side as politicaland administrative from another side.Regardless of the political systemor the intellectual orientations, these senior administrative jobs have become essential in every country because of their importance in implementing the government's policies and programs.After 2003, Iraq has undergone constitutional and political developments. The result of this change wasthe form of governance from a state with a presidential system (a simple state) tofederal system (shared state). This was followed by political, legal and administrative changes; particularly, when the Iraqi constitution of 2005 granted the provinces, which do not belong to a territory, theauthority to appoint and dismiss the occupants of these jobs. In addition,the multiplicity of departments and the different administrative configurations lead to the multiplicity, both qualitatively and quantitatively, of incumbents of senior administrative positions.The legal status of a person is the rights and the obligations determined by legislator and the legal status. As such, it includes what is called the central regulatory jurisprudence. This is because law determines the financial and non-financial rights of the employee as well as the required duties to make balance and encouraging them to work skillfully. It is also known that employees are not on one level or status; i.e. in the administrative hierarchy, there are subordinates and managers. In Iraq, the appointment in supreme administrative job- positions is connected to the discretionary power of the government; where usually the government hires only those who follow its policy and implement its orders
