Objectives of Shari'ah and its Relationship with the Balances

Abstract

Although objectives of Shari'ah have been widely investigated, studied and analyzed, previous scholars have not addressed the contextual definition of the objectives yet. Some signals that suggest the meaning of objectives and its relationship with interests, however, can be detected as in AL-Ghazali statement " the objectives of legislator for the creatures are five: to reserve their religious, souls, minds, descendants and money". As for AL-Emam AL-Shatiby, Shaikh of objectives, he isolated a special book within the agreement but he did not set a definite and precise definition of objectives. He only put a brief description of the interests as they are related to each other. Ibn Qayyim al-Jawziyyah in his book "I'lam al-Muwaqqi'in" mentioned the word qusood. He stated that " to consider qusood within contracts is more important than considering the other intended sayings since the contracts objectives are what they aim for".
