Abstract

AbstractAfter explaining the abandonments of the prophet (PBUH), it seems to me thqat the type of abandonment that can be fallen under our issue is the abandonment because of hardship that people may be afflicted by due to the following the example of the prophet (PBUH).This type of abandonment does not imply the reprehensibility of doing the abandonment thing, so this type cannot be used as evidence to prove the reprehensibility of repeating Umrah in the same journey. Thus, it remains as a desirable matter depending on the general meaning of the prophet's saying: (( Umrah is an expiation for the time between it and the previous Umrah )).It should be considered that Hanafiyah regards repeating Umrah reprehensible in five days namely, ( Arafah, day of immolation and the three days of Tashriq ). They depend of the traditions that indicate the reprehensibility of repeating Umrah in the mentioned days.The judgments of emergency circumstances should be taken into consideration since they prohibit repeating Umrah. The emergency circumstances may change the desirability or even into prohibition. For example, if one becomes certain or considers it is more likely to hurt those who are performing Umrah or Hajj when he competes them to perform the rites of Umrah specially at the Yamani corner and the corner of the black stone or when he competes them to perform prayer in Hijr Ismail (the north wall of the Kaaba ) or at Maqam Ibrahim ( the station of Ibrahim ). A voiding hurting Muslims is an obligation whereas repeating Umrah is desirable, so the prohibited matter cannot be committed for the sake of doing the desirable thing.
