Undoubtedly, with regard to international relations including making treaties, the federal government is on a better foot to represent the whole people of the state. The scope of the treaty making power is not controversial in unitary states, because there is only one centralized government practicing sovereignty in making treaties. In federal states, however, there is more than one sovereign body within the country, and in subsequence the federal government should always avoid encroaching on state reserved powers. The threat of unlimited treaty making power has strongly appeared as a parallel to the dramatic changes of contemporary international relations, and this relatively pushed law scholars and judges to reconsider the treaty making power. These judicial and jurisprudential disagreements about the treaty making power and its limits are the core subject of this paper.

الملخص تسعى هذه الدراسة للبحث في الأصول الدستورية لصلاحيات الدولة في توقيع المعاهدات الدولية ، لا شك في ان حصر صلاحية توقيع المعاهدات في يد الحكومة الاتحادية التي تمثل شعباً واحداً في علاقاتها مع الدول الاخرى تمثل مسالة طبيعية الى حد ما ، كما أن حصر صلاحية ابرام المعاهدات مع الدول الاخرى في يد الحكومة المركزية، قد لا تثير اية مشكلة فقهية او قضائية حول نطاق الصلاحية او القيود الواردة عليها ، لان الجهة الوحيدة التي تبرم و توقع على المعاهدات هي الحكومة المركزية و لا تنافسها اي سلطة محلية اخرى كالمحافظات مثلا. الا ان المشكلة الاساسية تظهر في نطاق صلاحية توقيع المعاهدات في الدول الفدرالية ، لان السيادة ستكون منقسمة بين الحكومة الفدرالية و الاقاليم، اي ان الاقاليم سوف تتمتع بجزء من سيادة الدولة، و في هذه الحالة تكون على الحكومة الاتحادية مسؤلية عدم الإعتداء على سيادة و صلاحية الاقاليم الممنوحة لهم دستوريا لابرام بعض المعاهدات الدولية أو المشاركة فيها لتنظيم الامور الداخلية للاقاليم. هذه الخلافات الفقهية و القضائية على الصلاحية تمثل المحور الأساس في هذا البحث.
