إن للتطورات الهائلة التي شهدها علم الطب اهمية كبيرة خصوصاً في مجال تقنيات الانجاب الصناعية والعلاج بالخلايا الجذعية ونقل وزراعة الاعضاء اضافة الى البحوث الطبية , وازدادت تلك الاهمية بعد توسع نطاق هذه التقنيات من خلال الاقبال الواسع عليها من قبل المرضى الذين يعانون من العقم اوبعض الامراض المستعصية, وهذا التطور العلمي قد القى بضلاله على مفهوم الجنين البشري ووسع من ذلك المفهوم ليشمل الاجنة الناتجة من الاخصاب المساعد والاستنساخ البشري والتوالد البكري وغيرها من التقنيات الحديثة, ومع ذلك كله فان مفهوم الاجنة البشرية لم يحدد في القانون بنصوص صريحة, لذا لابد لنا من الرجوع الى القواعد العامة في القوانين محل المقارنة وهي القانون العراق والمصري والفرنسي, وكذلك الرجوع الى احكام الشريعة الاسلامية في قوانين الدول التي تجيز ذلك, وقد بدأنا هذه الدراسة بالبحث في التعريف بالاجنة البشرية لبيان ماهو الجنين ومتى تبدا اولى مراحل النمو لديه من خلال بيان الاطوار التي يمر بها والتي نص عليها القران الكريم ولم يختلف علماء الطب في تحديدها, اضافة الى بيان الصور المتعددة للاجنة, اذا كانت اجنة حية ناتجة من تلقيح طبيعي او صناعي سواء كان داخلي في رحم المراة او خارجي في انابيب الاختبار اويكون ناتجاً من استنساخ بشري او من التوالد الذاتي الذي تم بتحفيز البويضة الانثوية على الانقسام دون الحاجة الى خلايا الرجل, او قد تكون الاجنة ميته كالاجنة المجهضة لما لذلك من اهمية بالغة في تحديد الاحكام الشرعية والقانونية للانتفاع بها, كما بحثنا ايضا الطبيعة القانونية للجنين وبداية الحياة الانسانية له وتوصلنا الى انه يعد اولى مراحل الانسان ويحضى بالحماية القانونية من بداية التخصيب ولكن يختلف عن الانسان البالغ في الواجبات القانونية اذ انه يتمتع باهلية وجوب ناقصة, وانتهينا في الخاتمة الى عدد من النتائج والتوصيات.
