The study shows that parties to a dispute may opt resorting to arbitration upon conclusion of their original commercial agreement. In such a case the agreement is referred to as arbitration clause, which is the condition stipulated by the contracting parties and refers whatever future dispute to an arbitrator or arbitrators to decide on such matters. In addition, the study demonstrated that even if there was no written agreement, the contracting parties may resort to the arbitration, and mutually agree on arbitration for future disputes in writing. This type is known as arbitration condition under which no party may resort to court unless with protestation by the other party. Further, this study demonstrated that disputants may choose the applicable law regarding the dispute as entitled by law under which litigants may resort to arbitration and choose the applicable law. The arbitrator, who represents the judge, with the power of settling disputes as emanated from the will of parties and the law by which he is entitled to practice judgment among the litigants, and given the authority to consider disputes, and entering judgments, shall have specific qualities including legal competency, expertise and efficacy. © 2019 TUJR, College of Right, Tikrit University

تناول هذا البحث حرية الأطراف في العلاقات التجارية في اختيار من يقومون بالتحكيم فيما بينهم في المسائل المختلف عليها من قبلهم حول تنفيذ العقد أو أي من بنوده, وبينت أن أطراف النزاع يستطيعوا أن يختاروا اللجوء إلى التحكيم عند إبرام العقد الأصلي فيما بينهم فيما يخص العلاقة التجارية، وفي هذه الحالة يسمى هذا الاتفاق بشرط التحكيم، وهو الشرط الذي يضعه أطراف العقد و يحيل ما يحصل بينهم من خلاف في المستقبل إلى محكم أو محكمين للتحكيم فيما بينهم في هذه المسائل, وكذلك بينت انه يستطيع أطراف العقد وان لم يكن هناك اتفاق مكتوب بالعقد باللجوء إلى التحكيم، أن يتفقوا على ذلك عند نشوء النزاع في المستقبل ويتم كتابة هذا الاتفاق وهو ما يسمى بمشارطه التحكيم، وبذلك لا يستطيع أي من الطرفين اللجوء إلى القضاء العادي إلا إذا لم يعترض الخصم على ذلك، هذا بالإضافة إلى بيان أن لأطراف النزاع الحق في أن يحددوا القانون الواجب التطبيق على هذا النزاع. أن من يقوم بمهمة التحكيم لابد له من أن تتوافر فيه عدد من الشروط، لكون المحكم يمثل دور القاضي ويستمد سلطته في الفصل في النزاع من أرادة طرفي العقد اومن القانون ، ومنحته سلطة النظر بالنزاع ومن ثم إصدار الحكم ومن هذه الشروط أن يتمتع المحكم بالأهلية القانونية أللازمة لمثل هذا العمل و الخبرة والكفاءة.} }
