International standards tend to set a minimum age of 15 years for the recruitment of children, regardless of the contexts in which these child soldiers participate and why they may actively and effectively participate in hostilities. Moreover, these children may be targeted in the same way as their adult counterparts, although there may be ethical or practical reasons to avoid being targeted if possible, there is no obligation under international law to treat them in a different way than adult combatants, creating a gap that requires debate to fill this legal void

تركز هذه الدراسة على موضوع الاستهداف العسكري للطفل المجند في العـمـلـيـات الـعـدائـيـة في نطاق الـقـانـون الـدولـي الإنـســانـي والقانون الـجـنـائـي الدولي, إذ تميل المعايير الدولية إلى تعيين سن الخـامـسـة عـشـرة سنة كحد أدنى لتجنيد الأطـفـال, وبغض النظر عن السياقات التي يشارك فيها هؤلاء الأطـفـال الـمـجـنـديـن _ولماذا_ فقد يشاركون بشكل نشط وفعال في العـمـلـيـات الـعـدائـيـة. فضلاً عن ذلك قد يتم استهداف هؤلاء الأطـفـال الـمـجـنـديـن بنفس طريقة استهداف نظرائهم البالغين, على الرغم من إنه قد تكون هناك أسباب اخلاقية او عملية لتجنب استهدافهم إن امكن، إلا إنه لا يوجد التزام بموجب الـقـانـون الـدولـي بمعاملتهم بطريقة مختلفة عن الـمـقـاتـلـيـن البالغين, ما أدى إلى خلق فجوة تستوجب النقاش لسد هذا الفراغ القانوني ER -
