لم يكن تحريم استخدام القوة في العلاقات الدولية مسألة سهلة، حيث كان اللجوء لها لفض الخلافات الدولية أمراً مشروعاً حتى تبنّى ميثاق منظمة الأمم المتحدة الذي حرّم استخدامها أو التهديد باستخدامها عدا في حالات محدّدة بنصوص الميثاق، حيث لا يصحّ استخدام القوة إلا في حالتي الدفاع الشرعي الفردي أو حال اتخاذ إجراءات جماعية من طرف مجلس الأمن. لكن الظروف تقتضي أحيانا استخدام القوة بشكل سريع لرد العدوان المباغت بشكل لا يسمح بالتأكد من كون الحالة مبرّرة بحالة الدفاع الشرعي أم لا، كما تغيّرت أيضا معالم الحروب التقليدية لتظهر حروب بأشكال جديدة كالحرب على الارهاب والحروب الاستباقية التي لا يمكن بأي حال من الأحوال أن تحكمها قواعد ومبادئ حظر استخدام القوة بسبب كونها غير واضحة الحدود والمعالم، غير أنه من الواجب القول بأنّه إن كان من الجائز الخروج على مبدأ حظر استخدام القوة فإنّ هذا الخروج مقيّد بقواعد حدّدها القانون حتى لا يتحول إلى عدوان. لم تعد معالم وحدود مبدأ حظر استخدام القوة في العلاقات الدولية بنفس الوضوح الذي كانت عليه وقت توقيع ميثاق منظمة الأمم المتحدة وذلك بسبب تغيّر المحددات الزمانية والمكانية والشخصية وتغيّر نطاق انطباق القانون، حيث أصبحنا نشهد صعود كيانات من غير الدول تستخدم القوة بشكل لا يمكن معه إدانتها لأنّ القواعد التقليدية لا تنطبق عليها، وهو ما يوجب ضرورة المراجعة السريعة لقوانين الحرب ولميثاق المنظمة الأممية.} }
