The excuse, whereby the judge is obligated to amend the punishment to suit the circumstances of the offender ,The purpose of the penal system is to combat the phenomenon of crime, and this was only possible by knowing its causes. Therefore, it is the duty of the criminal judge to search for the circumstances that led to the path of the crime and study his own circumstances to reduce the crime and choose the appropriate punishment. Accordingly, most of the legislations adopted the idea of an excuse and required the criminal judge to reduce the punishment according to the state of excuse and its conditions in a binding manner. Therefore, the criminal judge has the authority to choose the appropriate penalty within the limits set by the legislator for him.

إن الأعذار القانونية هي محصلة لفكرتين فلسفيتين هما فكرة المنفعة وفكرة العدالة والتان دعا لهما كلا من المدرسة التقليدية والمدرسة الوضعية، حيث نجد معظم التشريعات الجنائية قد تبنت فكرة الأعذار من خلال حصر الوقائع والظروف التي اعتبرها المشرع أعذار تلزم القاضي الجنائي بتحقيق العقاب على الجاني كلا حسب حالة العذر، حيث يلتزم القاضي بتعديل العقوبة بما يتلاءم بظروف الجاني، إن الغرض من النظام العقابي هو مكافحة ظاهرة الجريمة، وهذا لم يتأتى إلا بمعرفة أسبابه، لذا من الواجب على القاضي الجنائي البحث عن الظروف التي أدت إلى اتباع سبيل الجريمة ودراسة ظروفه الخاصة للتخفيف من الجريمة واختيار العقوبة المناسبة. عليه فقد تبنت اغلب التشريعات فكرة العذر وأوجبت على القاضي الجنائي تخفيف العقاب حسب حالة العذر وشروطه بصورة ملزمة، لذا فان القاضي الجنائي يتمتع بسلطة في اختيار الجزاء المناسب في اطار الحدود التي رسمها له المشرع ER -
