This paper sheds light on the Islamic law ordinances with regard to international relations at the time of war. The basis of international relations in Islam is peace and not resorting to war just in case of necessity, self – defense, and protecting the state. If war is a necessity the latter has legal restrictions such as the following: the Muslim warrior shall not kill but for necessity and shall not damage property without excuse. It is strictly forbidden to burn the enemies, make them drown, or mutilate the dead bodies. It is also forbidden to kill ones parents if they are non – Muslim enemy fighters. Faqihs have agreed that it is forbidden to kill or harm, in any way, civilians who do not take part in fighting, such as women, children, monks, aged sheikhs, and those who are crazy or blind.

الشريعة الإسلامية أولت عنايتها بالعلاقات الدولية منذ بداية ظهور الإسلام ، والغاية من البحث ، التعرف على أحكام الشريعة فيما يخص العلاقات الدولية في وقت الحرب .وأساس العلاقات الدولية في الإسلام السلم ، وأنّه لا يجنح للحرب إلاّ في حالة الضرورة والدفاع عن النفس وحماية الدولة ، والحرب وإنْ كانت ضرورة ، لكن هناك مقيدات شرعية على هذه الضرورة منها ، على المحارب المسلم ألا يسفك دماً لا ضرورة لسفكه ، ولا يتلف مالاً دون مبرر ، ويحرم تحريماً قاطعاً إحراق الأعداء أو إغراقهم ، أو التمثيل بجثث الأموات منهم ، كما يحرم قتل الوالدين إذا كانا غير مسلمين ومقاتلين في جيوش الأعداء .وقد اتفق الفقهاء ، على أنّ المدنيين الذين لا يشتركون في القتال يحرم قتلهم أو التعرض لهم بأي نوع من الأذى ، كالنساء والأطفال والرهبان والشيوخ الطاعنين في السن والمصابين بالجنون والعمى .
