Sadi فرهاد سعيد سعدي PY - 2014 VL - 3 IS - 10 SP - 71 EP - 112 JO - Journal of college of Law for Legal and Political Sciences مجلة كلية القانون للعلوم القانونية والسياسية SN - 22264582 AB - تعتبر تكنولوجيا صناعة الادوية مقارنة بالمجالات الاخرى من التكنولوجيا من الصناعات الحيوية والمعقدة في نفس الوقت والتي تواجه منافسة شديد. مع ان اتفاقية تربس ومن خلال منظمة التجارة العالمية تفرض معايير حماية عالية بالنسبة للمنتجات الدوائية من خلال رفع سقف الحماية من العملية الصناعية الى المنتج نفسه، الا ان اصحاب الحقوق الفكرية في الادوية من الشركات المبتكرة يدعون بانهم يواجهون تحديات وثغرات في الحماية ومنها صعوبة استيفاء شروط منح البراءة من الجدة والخطوة الابتكارية، بالاضافة الى متطلب الموافقة التسويقية ويشترطه معظم الدول من خلال تقديم بيانات الفاعلية والامان والذي يتطلب القيام باختبارات مكلفة ومستغرقة للوقت مما يقلل مدة الحماية الفعلية بعد منح البراءة، يضاف الى ذلك قيام بعض الدول ومنها النامية باستيراد المنتج المطروح في السوق في دولة اخرى دون استيرادها من المنتج الاصلي مستغلة سياسة تمييز الاسعار بين الدول. والدول النامية من جانبها هي الاخرى تشتكي من الحماية القوية للابتكارات في هذا المجال التي جاءت بها الاتفاقية من خلال حماية المنتج دون عملية الصنع، فأغلب تشريعات الدول النامية قبل نفاذ اتفاقية تربس كانت تستند على حماية طريقة صنع المنتج الدوائي دون المنتج نفسه لتوفير الادوية بسعر مناسب لمواطنيها، اما بعد نفاذ الاتفاقية وحماية المنتج وفي ظل محدودية استثناءات الحماية تقوم الدول النامية بعملية الاستيراد الموازي مبررة ذلك على التزامها بحماية الحق في الصحة لمواطنيها. تكمن مشكلة البحث في بيان مدى شرعية الاستيراد الموازي، وهل يعتبر القيام بها تعديا على الحقوق الاستئثارية التي تمنحها براءة الاختراع. خلال الاستناد على فرضية استفاذ الحقوق الفكرية للمخترعين في مجال الادوية يمكن تبرير القيام بالاستيراد الموازي من قبل الدول النامية، حيث ان الحقوق الاستئثارية للمخترع يمكن ان يصطدم بحق المشتري بهذا الخصوص ولا يمكن استمرار تحكم المنتج في البضاعة بعد البيع الشرعي الاول في السوق. الا انه لاجل اعطاء الشرعية للاستيراد الموازي يجب تفسير نصوص اتفاقية تربس على اساس استنفاذ الحقوق الفكرية وتبني الاستنفاذ الدولي في تشريعاتها من خلال المادة 6 من الاتفاقية نفسها. وتناول بحث المشكلة والفرضية اعلاه من خلال النهج التحليلي في تفسير نصوص اتفاقية تربس على ضوء اهدافها ومن خلال الخطة التالية المقسمة الى مبحثين: متناولا في المبحث الاول ماهية المنتج الدوائي، وكيفية حمايته عن طريق براءة الاختراع ومتطرقا لفلسفة الحماية والتحديات التي تواجه المنتجين في هذا المجال. وفي المبحث الثاني تناولنا مفهوم الاستيراد الموازي، اساسه القانوني وانواع الاستيراد الموازي. ومختتما البحث ببيان تجارب بعض الدول في هذا المجال وامكانية ايجاد حلول تكفل قيام الاستيراد الموازي دون ان يشكل تحديا امام تجارة المنتجات الدوائية وتضمن توفير الادوية باسعار في متناول العامة من الناس. ومقترحا في الوقت نفسه حماية عادلة من الاستيراد الموازي ومن خلال نظرية العقد والمسؤولية العقدية دون الاستناد على حق الملكية بهذا الخصوص.

And developing countries for its part, is the other complaining of strong protection for innovations in this area that came out of the Convention through product protection without the manufacturing process, Most legislation developing countries before the entry into force of the TRIPS agreement was based on the protection of the way the product of drug-making without the product itself to provide medicines at an affordable price to its citizens , either after the entry into force of the Convention and the protection of the product and in the light of the limited exceptions to the protection of developing countries parallel importation process justified on its commitment to protect the right to health of its citizens.
