Criminalization based on custom In international criminal law

Abstract

The importance of this research is limited in two directions. The first is the attempt to discover the special feature of the legal structure in international criminal law, and consequently the statute of the International Criminal Court or some of the provisions of this law. The second is the role played by the custom in criminalization. Of great importance is the fact that international criminal jurisdiction can be grounded in a customary rule to criminalize the conduct of accused persons, although this is true for criminalization, and is it correct for punishment. The difference of the concept of the corner of legitimacy in Latin jurisprudence than in the Anglo-Saxon jurisprudence is the most complex difficulty faced by the research as there is a clear difference between the meaning of this principle in both jurisprudence,
