Abstract

Abstract This research tackles confession (declaration against interest), for its importance as one of the criminal proofs. We have shown the definition of confession, its types, its power as evidence, and the freedom of the court to consider it partially or totally. It has been found that though the confession is an important proof, it cannot be considered "the master of evidence". This is due to the fact that the suspect may confess under conditions such as psychological disorder, feeling pity to save another person or feeling proud of a heroic action. Whatever is the reason, it is not possible to consider the confession against interest the main evidence to take the final decision, unless it is the only proof available. The research concludes that the confession against interest is an important subtle proof to settle the case presented to the court if accompanied by certain guarantees.
