Abstract

The subject of research in the agency in concluding the contract of marriage and divorce concludes a comparative study between the Iraqi law and the Islamic law in that a person other than the original in the contract concludes the contract and all the effects of the contract are disposed of to the principal, the original party in the contract. This may be inherent in circumstances that may not be possible. The contract is concluded in the circumstances that surround it, and the husband may also assign another person to divorce. The agent will divorce the wife on his behalf. This is a dispute between the Iraqi law and the Islamic law. The Sharia allows the agency for the wife and non-wife to divorce. The wife is allowed to divorce through the agency from the husband, so we will separate the subject of the agency in marriage and divorce in two sections devoted to the first section of the concept of the Agency and we will discuss in the second section of the agency in marriage and divorce and if we finished all of this research concludes with the most important results and proposals.
