الماوردي بين إشكالية المثالية والواقعية

Abstract

AbstractThis study is an attempt to clarify the differences between the readings of al-Mawardi's "al-Ahkam al-sutanniye by contemporary orient lists and Arab researchers, who reqarded his views as idealistic in depending on Islamic experience of the early Islamic history, and other readers who contradicted the above mentioned reading by classifying al-Mawardi views as representing a realist trend (school). The writer concluded that the impact of Greek thought was the main cases in regarding al-Mawardi as idealistic or as realist. There is on doubt that they where not succeeded in depending this measure. The writer see that one must go back to the Islamic culture and understanding the origins of the methods of Islamic "Fiqih" to reach an objective assessment for al-Mawardi's views. The other conclusion of the writer is that al-Mawardi was not a fundamental Faqih in this book.
